1. What Information Do We Collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include:

  • Names
  • Phone numbers
  • Email addresses
  • Job titles
  • Usernames
  • Passwords
  • Contact preferences
  • Contact or authentication data
  • IP addresses
  • Online identifiers
  • Internet activity / usage data
  • Device & browser information
  • Approximate location data
  • Interaction data
  • Session recordings / heatmaps

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

  • AI interaction data related to coaching conversations
  • Reflection and journal entries
  • Goal and productivity behavior data
  • Personality and motivation data
  • Emotional state and mental well-being data
  • Health data
  • Mood and self-assessment data
  • Behavioral patterns related to productivity and focus
  • Health and wellness metrics from connected devices
  • Coaching interaction transcripts

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number and the security code associated with your payment instrument. All payment data is handled and stored by Apple App Store (In-App Purchases) and Google Play Store (Google Play Billing). You may find their privacy notices here: https://www.apple.com/legal/privacy/ and Google Payments Privacy Notice.

Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Google or Apple account. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in 'How Do We Handle Your Social Logins?' below.

Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including HealthKit and other features. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider and/or mobile carrier, and IP address (or proxy server).
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.
  • Local Device Storage. The app stores your data locally on your device in a secure database. Typical usage results in approximately 100 MB of local storage. You can review your current storage usage at any time under Your Data → Storage in the app settings.
  • iCloud Sync. If you enable iCloud Sync (found under Your Data → iCloud Sync), your journal entries, goals, focus sessions, and associated media are synchronized with Apple's iCloud service. This is an optional feature controlled entirely by you. When the Offload Assets option is active, local copies of media files (photos, videos, voice memos, and other assets) that have been successfully synced to iCloud are automatically removed from your device to free up local storage — your data remains accessible through iCloud. Apple's handling of your iCloud data is governed by the Apple Privacy Policy.
  • Google Drive Sync (Android). If you enable Google Drive sync (under Your Data), your journal entries, goals, focus sessions and associated media are stored in a private app folder in your own Google Drive that only FocusPilot can access. This is optional and controlled entirely by you. Google's handling of this data is governed by the Google Privacy Policy.
  • Health Data (Apple Health and Health Connect). If you connect Apple Health or Health Connect, FocusPilot reads only the data types you allow. On iOS: step count, heart rate, resting heart rate, heart rate variability and sleep. On Android (Health Connect): steps, sleep and, if you allow it, your past health data. On iOS, if you allow it, FocusPilot also saves the mood from your Today's Read check-in to Apple Health as State of Mind. We use health data only to provide FocusPilot's features: to show your sleep and recovery in Insights and to personalise Today's Read, the Mentor Brief and Mentor conversations (health summaries are processed by our AI Service Providers, see 'Do We Offer Artificial Intelligence-Based Products?'). We never use health data for advertising or marketing, we never sell it, we never share it with data brokers, and we never use it to train AI models. You can stop access at any time in the Health app (iOS) or in Health Connect (Android).
  • Location for Place Reminders. If you add a place reminder to a goal or task, FocusPilot uses your device's precise location so it can remind you when you arrive at or leave that place. The place you choose is saved with that goal or task, and to show its address we send its coordinates to OpenStreetMap (Nominatim). Arrival and departure are detected by your device's operating system, also when the app is closed or not in use (on Android this needs the "Allow all the time" permission). We do not track your location continuously and never use it for advertising. You can turn off location access in your device settings at any time.
  • Microphone and Speech Recognition. If you record a voice note or dictate text, FocusPilot uses your microphone. Voice notes are stored with your entry. Dictation is converted to text by your device's speech recognition service (Apple or Google).
  • Camera, Photos and Files. If you take a photo, choose a picture or attach a file (for example to a journal entry, a goal or a Mentor conversation), FocusPilot accesses only the items you select. Attachments are uploaded to our cloud storage so they are available across your devices, and files you share with the Mentor are processed by our AI Service Providers to answer you.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes. How We Process Your Data Using AI

To answer you and to generate the Mentor Brief, Today's Read, Plan My Day, insights and journal prompts, we send the relevant context to our AI Service Providers. Depending on the feature, this can include your messages and the files you attach, your goals, tasks and progress, your check-ins and journal entries, and summaries of your health data (such as sleep, steps and heart rate measures).

Our AI Service Providers process this data on our behalf to generate the response. Under their API terms they do not use it to train their models and keep it only for a limited period (generally up to 30 days) for security and abuse monitoring. AI responses can be inaccurate and are not medical advice.

You stay in control: you can turn off the use of journal entries in Mentor conversations (Settings → Preferences → Journal in Mentor chat), reset what the Mentor remembers (Settings → Preferences → Reset Mentor memory), delete Mentor conversations, and disconnect health data at any time. All personal information processed using our AI Products is handled in line with this Privacy Notice and our agreements with third parties.

7. How Do We Handle Your Social Logins?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third‑party social media account details (like your Google or Apple account). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the provider, but often includes your name, email address, friends list, and profile picture, as well as other information you choose to make public.

We will use the information we receive only for the purposes described in this Privacy Notice or as otherwise made clear to you on the relevant Services. We do not control, and are not responsible for, other uses of your personal information by your third‑party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences.

8. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in EU‑north‑1, the United States, and Estonia. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see 'When and With Whom Do We Share Your Personal Information?' above), including facilities in the United States, United Kingdom, Estonia, and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses. We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third‑party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third‑party service providers and partners, and further details can be provided upon request.

9. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than three (3) months past the termination of the user's account.

When you delete your account, your data is removed from our active systems right away. Copies in our backups are deleted within 90 days. Purchase and transaction records that we must keep for accounting and tax purposes are kept for up to 10 years, as Swiss law requires; they contain no journal, goal or health content.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. Do We Collect Information From Minors?

If you are at least 13 but a minor in the jurisdiction in which you reside (generally under the age of 18), you may use the Services only with the permission and supervision of your parent or guardian, as set out in our Terms and Conditions. Where the law of your country sets a higher age at which you can consent to the processing of your personal data on your own (in the European Union, between 13 and 16 depending on the Member State), we rely on consent only where it has been given or authorised by your parent or guardian.

If we learn that personal information from users under 13 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 13, please contact us at legal@focuspilot.ai.

12. What Are Your Privacy Rights?

In Short: Depending on your state of residence in the US or in some regions (such as the EEA, UK, Switzerland, and Canada), you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us using the contact details provided in 'How Can You Contact Us About This Notice?' below.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in 'How Can You Contact Us About This Notice?' below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in 'How Can You Contact Us About This Notice?' below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Cookies and similar technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 13. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognising or honouring DNT signals, we do not respond to them at this time.

14. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

To exercise these rights, you can contact us by submitting a data subject access request or by emailing us at legal@focuspilot.ai, or by referring to the contact details at the bottom of this document.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at legal@focuspilot.ai. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decision. If your appeal is denied, you may submit a complaint to your state attorney general.

California 'Shine The Light' Law

California Civil Code Section 1798.83 (the 'Shine The Light' law) permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact details in 'How Can You Contact Us About This Notice?'.

15. Do We Make Updates to This Notice?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

  • Name
  • Telefonnummer
  • E‑Mail‑Adresse
  • Berufsbezeichnung
  • Benutzername
  • Passwort
  • Kontaktpräferenzen
  • Kontakt‑ oder Authentifizierungsdaten
  • IP‑Adresse
  • Online‑Kennungen
  • Internet‑/Nutzungsdaten
  • Geräte‑ und Browser‑Informationen
  • Ungefähre Standortdaten
  • Interaktionsdaten
  • Sitzungsaufzeichnungen / Heatmaps

Sensible Informationen.

Social‑Media‑Login‑Daten.

State of Mind) in Apple Health speichern.

  • Textanalyse
  • KI‑gestützte Vorhersagen (Predictive Analytics)
  • KI‑Bots
  • KI‑gestützte Insights
  • Machine‑Learning‑Modelle
  • Natural Language Processing (Sprachverarbeitung)

13. Steuerung von Do‑Not‑Track‑Funktionen

14. Haben Einwohner der Vereinigten Staaten besondere Datenschutzrechte?

Kurzfassung: Wenn Sie in bestimmten US‑Bundesstaaten ansässig sind (u. a.

Das „Shine The Light"‑Gesetz Kaliforniens
